By accessing or using the Marine Vista Homes platform, including our website and any associated services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Marine Vista Homes.

If you do not agree with any part of these terms, you must discontinue use of the platform immediately. We reserve the right to modify these terms at any time, and your continued use of the platform following any changes constitutes acceptance of those modifications.

To make bookings on our platform, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be at least 18 years of age to create an account.

You agree to notify us immediately of any unauthorized access to or use of your account. Marine Vista Homes is not liable for any loss or damage arising from your failure to safeguard your account credentials. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

You may not create multiple accounts for deceptive purposes, provide false information during registration, or allow others to use your account without authorization. We reserve the right to verify the identity of account holders at any time.

Bookings are confirmed only upon successful payment processing through Stripe. You will receive a confirmation email with your reservation details, including property address, check-in instructions, and house rules. All prices are displayed in Canadian Dollars (CAD) and include the nightly rate, cleaning fees, service fees, and applicable taxes.

You are responsible for verifying all booking details, including dates, guest count, and property specifics, before completing your reservation. Pricing is accurate at the time of checkout, though we reserve the right to correct pricing errors. In the event of a significant pricing error, we will notify you and offer the option to proceed at the correct price or cancel for a full refund.

Security deposits may be pre-authorized on your payment method at the time of booking. The deposit amount varies by property and is clearly displayed before checkout. If no issues are reported after your stay, the pre-authorization is released within five to seven business days.

Cancellation policies vary by property and are clearly displayed on the property listing page before you complete your booking. Please review the applicable cancellation policy carefully before confirming your reservation. Refunds for eligible cancellations are processed to the original payment method within five to ten business days.

Service fees may be non-refundable depending on the timing of your cancellation relative to the check-in date. Force majeure events, including natural disasters and government travel restrictions, are handled on a case-by-case basis. All guests are expected to treat properties, their contents, and surrounding neighbourhoods with respect. You must comply with property-specific house rules provided in the listing and booking confirmation. Maximum occupancy limits must be respected at all times, and exceeding them may result in immediate termination of your stay.

Unauthorized parties, events, or gatherings are prohibited at all properties. Smoking is not permitted unless explicitly stated in the listing. Quiet hours are in effect from 10 PM to 8 AM. Pet policies are determined on a per-property basis. Violations may result in termination of your stay without refund and forfeiture of the security deposit.

Guests are liable for any damage to the property, its furnishings, or appliances caused during their stay. Damage costs will be deducted from the security deposit. If damage exceeds the deposit amount, we reserve the right to charge additional costs to the payment method on file.

Marine Vista Homes acts as a platform connecting guests with vacation rental properties. To the fullest extent permitted by law, we are not liable for property conditions beyond reasonable standards, personal injury occurring at a property, loss or damage to personal belongings, or service interruptions caused by circumstances beyond our control.

Our total liability in any matter arising from your use of the platform or your stay is limited to the total amount paid for the applicable booking. We make no warranties, express or implied, regarding the condition, safety, or suitability of any property listed on our platform, though we work diligently with property owners to maintain quality standards.

All content on our platform, including text, images, photographs, logos, graphic design, page layouts, and software, is the property of Marine Vista Homes or its licensors and is protected by Canadian and international copyright and trademark laws. Unauthorized reproduction, distribution, or modification of any content without prior written consent is prohibited.

You may not scrape, data mine, or use automated methods to access our platform without express written permission. Any content you submit, such as reviews or photographs, remains your property, but you grant us a non-exclusive, royalty-free license to use, display, and distribute that content in connection with our services.

In the event of a dispute arising from a booking or your use of our platform, we encourage you to contact our support team first. We are committed to resolving issues fairly and efficiently. Most disputes can be settled through direct communication between the guest, property owner, and our team.

If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing litigation. Any formal legal proceedings shall be conducted in accordance with the laws of the Province of British Columbia, Canada, and subject to the jurisdiction outlined in the Governing Law section below.

These Terms of Service are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law principles. Any disputes arising from or relating to these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of British Columbia.

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
